The French version of the Terms of use for brands – Buying guide is the legally binding version. In the event of any differences or inconsistencies between language versions, the French text shall prevail: Conditions d’utilisation pour les marques – Guide d’achat
The Buying guide is published by Geert De Vuyst, a business registered under SIRET number 444 555 171 00057, located at 2 rue d’Austerlitz, 31000 Toulouse, France (hereinafter referred to as the “Publisher”).
These Terms of use govern the participation of brands in the Buying guide, including the conditions for registration, publication and management of brand information.
They supplement the Terms and conditions applicable to the Publisher’s websites, which remain fully in force. In the event of any conflict, these Terms of use take precedence in matters specifically relating to the participation of brands in the Buying guide.
By accepting these Terms of use, the company participating in the Buying guide (hereinafter referred to as the “Brand”) acknowledges that it has read and agrees to comply with them.
The Publisher keeps a record of the date on which the Brand accepted the Terms of use, together with the version accepted.
If these Terms of use are amended, the Brand must accept the new version to continue managing and publishing its information in the Buying guide.
Brand eligibility requirements
The Buying guide is open to producers and brands of essential oils, hydrosols and other plant extracts used in aromatherapy, subject to the following criteria:
– The company that owns the brand must have its registered office in the European Union.
– The Brand’s products must be sold to consumers (B2C) in at least one European Union country.
– The Brand undertakes to provide accurate, transparent and up-to-date information.
– The Brand must comply with applicable regulations and ensure that the information it provides is reliable and not misleading.
– The Brand must not engage in multilevel marketing (MLM), regardless of its distribution model.
Registration in the Buying guide is subject to these Terms of use.
Each registration application is reviewed individually. The Publisher reserves the right, at its discretion, to accept or reject an application or to remove a brand from the Buying guide.
Intellectual property rights and content licensing
The Brand’s authorised representative declares that they hold the necessary rights and permissions to provide the information and content submitted to the Buying guide and to authorise their publication.
On behalf of the Brand, the authorised representative grants the Publisher permission to reproduce, publish and distribute this content within the Buying guide.
The textual answers and descriptions entered by the authorised representative in the fields of the Brand’s documented profile are made available under the [Creative Commons Attribution-NoDerivatives 4.0 International licence (CC BY-ND 4.0)](https://creativecommons.org/licenses/by-nd/4.0/). On behalf of the Brand, the authorised representative authorises their reproduction and distribution, including for commercial purposes, in accordance with the terms of this licence.
This licence does not apply to brand names, logos, images, certificates, supporting documents, external links or other third-party content. The Publisher’s use of such materials is limited to what is necessary to present and document the Brand in the Buying guide, insofar as the required rights have been granted.
Rights holders retain their intellectual property rights in the content provided.
Governing law and dispute resolution
These Terms of use are governed by French law.
In the event of a dispute relating to the Buying guide, the Brand and the Publisher agree to first seek an amicable resolution through direct dialogue, without prejudice to either party’s legal rights.
Subject to mandatory rules of jurisdiction, the competent courts of Toulouse, France, shall have exclusive jurisdiction over disputes relating to these Terms of use.
